1. Who this policy covers
This policy explains how the companies handle personal information collected through morlarealty.com and in the ordinary course of owning, leasing, managing, acquiring, and selling real property. It applies to visitors to this website, rental applicants, tenants and their occupants and guarantors, property sellers and buyers, vendors and contractors, and people who contact us.
It does not apply to information you provide to a third party through its own site or service, including the tenant portal described in Section 6.
2. Information we collect
We collect only what we need for the relationship in question. Depending on that relationship, this may include:
- Contact information — name, mailing address, email address, telephone number.
- Inquiry information — what you tell us in a form, email, text message, or voicemail, including which company and subject you select.
- Application and tenancy information — dates of birth, government identification numbers, employment and income information, rental and residence history, references, occupants, pets, vehicles, emergency contacts, and accommodation requests.
- Financial information — payment method details, bank or card information used for rent or deposits, payment and balance history, and, for applicants, credit and background report results.
- Property and transaction information — records relating to a property you own, occupy, are selling, or are financing, including maintenance requests, inspection notes, photographs of property conditions, correspondence, and lease or contract documents.
- Technical information — IP address, browser and device type, pages viewed, referring page, and dates and times of access, collected automatically by our web host.
We do not sell personal information, and we do not share it for cross-context behavioral advertising.
3. Where the information comes from
Most of it comes directly from you. We also receive information from consumer reporting agencies and screening services, current and former landlords and employers you list as references, co-applicants and guarantors, property managers, brokers, title and escrow agents, lenders, insurers, contractors and vendors, public records, and our own website logs.
4. How we use information
We use personal information to respond to inquiries; evaluate rental applications; prepare, sign, and administer leases and contracts; collect rent and other amounts owed; schedule and perform maintenance and repairs; manage, insure, and protect the properties; evaluate, finance, acquire, and sell property; keep accounting and tax records; comply with law, including fair housing, landlord-tenant, and financial recordkeeping requirements; enforce our agreements and defend legal claims; and communicate with you about your tenancy, transaction, or request.
5. When we share information
We share personal information only as needed, and only with:
- Service providers that work on our behalf — property management and portal software, payment processors, screening services, maintenance vendors and contractors, insurance carriers and agents, accountants, and attorneys.
- Transaction participants — brokers, lenders, title and escrow companies, appraisers, inspectors, surveyors, and, where a property is sold, the buyer and its lender, including assignment of leases and security deposits at closing as required by law.
- Government and legal recipients — when required by law, subpoena, court order, or lawful request, and when necessary to establish, exercise, or defend legal claims, to collect amounts owed, or to protect the safety of any person or property.
- Co-applicants, occupants, and guarantors, to the extent necessary to administer a shared application or tenancy.
Because the two companies are separate, information held by one is not shared with the other except where a specific transaction between them requires it and the disclosure is permitted by law and any applicable agreement.
6. The tenant portal
The tenant portal is operated by TurboTenant, an independent third-party service. When you sign in, apply, or pay through the portal, you provide information directly to TurboTenant, and its own privacy policy and terms of use govern that information. We receive from TurboTenant the application, tenancy, payment, and maintenance information we need to operate the properties. We do not control TurboTenant's practices and are not responsible for them. Review TurboTenant's privacy policy before using the portal.
7. Applicant screening reports
Rental applications may involve a consumer report — credit history, eviction and rental history, criminal background, or income verification — obtained from a consumer reporting agency, and we obtain your written authorization before requesting one. If we decline an application, increase a deposit, or require a guarantor based in whole or in part on information in a consumer report, we will provide the adverse action notice required by the federal Fair Credit Reporting Act, 15 U.S.C. § 1681 et seq., identifying the agency that furnished the report and informing you of your right to obtain a free copy of it and to dispute its accuracy directly with that agency. The agency did not make the decision and cannot explain it.
8. Cookies and site analytics
This website does not use advertising cookies or third-party tracking pixels. Our web host keeps standard server logs, and your browser may store ordinary session data. If we later add analytics, we will update this policy and identify the service. Because there is no consistent industry standard for honoring browser "Do Not Track" signals, this site does not respond to them.
9. How long we keep information
We keep personal information as long as needed for the purpose it was collected and then for the period required by applicable law, contract, insurance requirements, and our recordkeeping and tax obligations, and for as long as necessary to resolve disputes and enforce agreements. Applications that do not result in a tenancy, and the screening records supporting them, are retained for the period required to document compliance with fair housing law and then disposed of securely.
10. Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information against loss, misuse, and unauthorized access. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Do not send Social Security numbers, financial account numbers, images of identification, or other sensitive information through the website contact form or by unencrypted email — use the tenant portal or ask us for a secure method.
11. Your choices and requests
You may ask us to confirm what personal information we hold about you, provide a copy of it, correct inaccuracies, or delete information we are not required to keep. You may opt out of marketing messages at any time; we will still send communications necessary to your tenancy or transaction, such as notices, statements, and repair scheduling. Send requests to the address in Section 16, identify which company your request concerns, and expect a response within thirty days. We may need to verify your identity before acting, and we may decline a request where the law permits or requires us to retain the information.
12. State privacy rights
The rights described in Section 11 are offered as a matter of practice. The Florida Digital Bill of Rights, sections 501.701–501.719, Florida Statutes, applies to businesses that meet revenue and data-volume thresholds the companies do not currently meet, and neither company is a "controller" as that statute defines the term. If either company becomes subject to that statute or to another state's consumer privacy law, this policy will be updated to describe the statutory rights and the process for exercising them.
13. Children
This website is directed to adults. We do not knowingly collect personal information online from children under 13. We do collect the names, dates of birth, and occupancy details of minor occupants from the adult applicant or tenant responsible for a household, as part of administering a lease. If you believe a child has provided information through this website, contact us and we will delete it.
14. Other websites
This site links to sites we do not operate, including the tenant portal and listing services. We are not responsible for their content, security, or privacy practices, and a link is not an endorsement.
15. Changes to this policy
We may update this policy. The effective date at the top of the page shows when the current version took effect, and material changes will be posted here before they take effect. Continued use of the website after a change means you accept the updated policy.
